1. General
  • (a) EventoTix reserves the right to update, replace, or change these Terms at any time without notice. The latest version of the Terms will be posted on the Service. Continued use of the Service after any changes constitutes acceptance of those changes. You can review the most current version of the Terms at any time.
  • (b) EventoTix reserves the right to terminate your Account at any time and for any reason, with or without notice. EventoTix may refuse service to any user.
  • (c) EventoTix may modify or discontinue the Service, or any part of it, at any time without notice.
  • (d) Disclaimer Regarding Partner Outages: While we strive to provide uninterrupted service, we are not liable for outages or disruptions caused by our downstream partners, such as payment processors, cloud service providers, and other third-party services. In the event of an outage, we will work to resolve it as quickly as possible and minimize any inconvenience to our users.
    • 2. Privacy and Consumer Information
  • (a) Your privacy is important to us. Information you provide to EventoTix is governed by our Privacy Policy.
  • (b) If you are a Seller, you agree to comply with all applicable laws regarding the collection and use of customer information.
    • 3. Your Account
  • To access all features of the Service, you may need to create a user Account (the “Account”). You agree to keep your Account secure and be responsible for all actions taken through it.
  • You must be at least 18 years old.
  • You have not been previously banned from the Service.
  • The information you provide is accurate and will be kept updated.
  • Your Account is personal and should not be shared.
  • You are responsible for any content you post and agree not to post offensive or illegal content.
  • You will not use the Service to infringe on others’ intellectual property rights.
  • You agree to use the Service legally and responsibly.
  • You will not interfere with or misuse the Service.
  • EventoTix reserves the right to change its fees, features, and terms of service at any time.
    • 4. Buyer and Seller Responsibilities
  • Sellers are solely responsible for providing accurate event details, fulfilling ticket purchases, and organizing events as advertised.
  • Buyers are responsible for verifying event details before completing a purchase. EventoTix is not liable for any misrepresentation, non-performance, or disputes between Buyers and Sellers.
    • 5. Platform Role and Responsibility
    EventoTix is a ticketing platform that facilitates the sale and purchase of event tickets between organizers ("Sellers") and attendees ("Buyers"). EventoTix does not organize, host, or manage the events listed on the platform and is not responsible for.
  • The accuracy of event details provided by Sellers.
  • The quality, safety, or legality of events.
  • Any changes, cancellations, or disputes arising from events.
    • 6. Content Responsibility
    Users are strictly prohibited from uploading, posting, sharing, or otherwise distributing content that is deemed offensive or illegal. Offensive or illegal content includes, but is not limited to.
  • Hate speech, harassment, bullying, or defamatory statements.
  • Obscene, vulgar, or explicit material unsuitable for public viewing.
  • Content that infringes intellectual property rights, including unauthorized use of copyrighted or trademarked material.
  • Content promoting or facilitating illegal activities, including fraud, drug sales, or human trafficking.
  • Content involving the exploitation or endangerment of minors.
  • Content promoting terrorism, violence, or self-harm.

    • Event Community Members must refrain from posting abusive, defamatory, or infringing content and respect intellectual property rights.

    Sellers are responsible for moderating their communities, ensuring compliance with these Terms, and sending only legitimate event-related communications.

    EventoTix reserves the right to remove any content that violates these standards without prior notice. Users found in violation may have their accounts suspended or terminated, with repeat or severe offenders permanently banned. Sellers failing to moderate appropriately may also face penalties.

    7. Community Features

    EventoTix offers a platform for creating online communities around events. Sellers may manage these communities and moderate content. EventoTix reserves the right to delete any content or community that violates these Terms or is deemed inappropriate.

    8. Payments

    EventoTix supports multiple payment providers, including PayPal, Stripe, and Square. Sellers can use their existing accounts with these providers. EventoTix charges a service fee, which may be passed on to buyers depending on the Seller’s preferences.

    9. Refunds and Cancellations

    EventoTix does not handle refunds directly, as it serves as a marketplace for Sellers and buyers. Sellers may set their own refund policies. EventoTix service charges and payment processing fees are generally non-refundable.

    10. Copyright Policy

    EventoTix prohibits the posting of content that infringes on copyrights. To report copyright infringement, please contact support@eventotix.com with the necessary details.

    11. Limitation of Liability and Disclaimers

    EventoTix provides the Service without warranties, and it is not liable for any losses or damages arising from the use of the Service. Sellers are responsible for their events, and EventoTix cannot ensure attendee safety.

    12. Jurisdiction and Choice of Law; Dispute Resolution

    Any disputes arising from the use of the Service shall be governed by the laws of the State of Ohio, without regard to conflict of law principles. You agree to submit to the jurisdiction of Ohio courts.

    13. Arbitration Provision/No Class Action

    Claims related to the Service will be resolved through binding arbitration on an individual basis, with no class actions permitted.

    14. Chargebacks and Additional Payment Terms

    EventoTix handles payments through a payment gateway and is not responsible for chargebacks or payment disputes. EventoTix may charge additional fees for premium features or bundles.

    15. Intellectual Property

    All intellectual property on the Service remains the property of EventoTix or its licensors. You may not use EventoTix’s intellectual property without permission.

    16. General

    These Terms constitute the entire agreement between you and EventoTix regarding your use of the Service. For any questions, please contact support@eventotix.com EventoTix staff are available to assist with creating events and processing refunds upon account holder request, but EventoTix is not responsible for financial errors.

    17. Indemnification

    You agree to indemnify and hold EventoTix harmless from any claims or damages resulting from your use of the Service or violation of these Terms.
